By downloading, installing, or using OnlyFarms ("App") you agree to be bound by this End-User License Agreement ("Agreement"). If you do not agree, do not install or use the App.
You must be at least 13 years of age (or older if required by your local law) and have the legal capacity to enter into this Agreement. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and accepted these terms on your behalf.
Subject to your compliance with this Agreement, Kind Knight Games LLC ("KKG") grants you a limited, non-exclusive, revocable, non-transferable license to download and use the App for personal, non-commercial entertainment on devices you own or control.
You may not: (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile, or disassemble any part of the App; (c) rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the App or any rights in it; (d) use automated scripts or exploits; (e) remove proprietary notices or labels; or (f) use the App for any unlawful purpose.
KKG and its licensors retain all rights, title, and interest in and to the App and all content therein, excluding on-chain assets generated by you under Section 6. No rights are granted except as expressly stated in this Agreement.
Gameplay may create non-fungible tokens (NFTs), fungible tokens, or other blockchain-based assets ("Digital Assets") governed by smart contracts deployed on Solana. Ownership, transfer, and use of Digital Assets are entirely managed by the applicable smart contracts and Solana network. KKG makes no guarantees regarding functionality, value, or permanence of Digital Assets.
The App may include virtual currency that can be earned, purchased, or otherwise obtained. Virtual currency is licensed, not sold, and has no real-world monetary value. KKG may modify, regulate, or remove virtual currency at any time.
You are responsible for your actions and communications within the App. You agree not to harass, threaten, or defraud other users; not to upload content that is illegal, obscene, or infringing; and not to interfere with network or gameplay integrity.
Certain features may be offered as beta. Beta features are provided "AS IS" with no warranties. You grant KKG a perpetual, royalty-free license to use any feedback you provide.
KKG may provide patches, updates, or modifications that must be installed for continued use. KKG may change or discontinue the App or any portion thereof at any time.
Your use of the App is also subject to the OnlyFarms Privacy Policy, which explains how we collect, use, and protect your information.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. KKG DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KKG SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE APP. KKG'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO KKG IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless KKG, its affiliates, officers, and employees from any claims, damages, or expenses arising out of your breach of this Agreement or unlawful use of the App.
This License is effective until terminated. KKG may terminate it at any time without notice if you violate these terms. Upon termination you must cease all use and delete all copies of the App.
This Agreement is governed by the laws of Georgia (country), without regard to conflict-of-law principles. Any dispute shall be finally resolved by binding arbitration in Tbilisi under the Arbitration Rules of the Georgian International Arbitration Centre, unless local law grants you the right to litigate in your domicile.
You agree to comply with all export and sanctions laws and regulations that apply to the App.
If any provision is held invalid, the remaining provisions shall continue in full force and effect.
KKG may assign this Agreement without notice. You may not assign your rights under this Agreement.
This Agreement, together with the Privacy Policy and any additional terms to which you agree, constitutes the entire agreement between you and KKG regarding the App.
